A BILL making a supplementary appropriation in the state fund,
general revenue, to the department of health and human
resources - division of human services, fund 0403, fiscal year
2003, organization 0511, all supplementing and amending the
appropriation for the fiscal year ending the thirtieth day of
June, two thousand three.
Be it enacted by the Legislature of West Virginia:
That the total appropriation for the fiscal year ending the
thirtieth day of June, two thousand three, to fund 0403, fiscal
year 2003, organization 0511, be supplemented and amended to read
as follows:
TITLE II-APPROPRIATIONS.
Section 1. Appropriations from general revenue.

Any unexpended balance remaining in the appropriation for
Indigent Burials (fund 0403, activity 851) at the close of the
fiscal year 2002 is hereby reappropriated for expenditure during
the fiscal year 2003.
The above appropriation for James "Tiger" Morton Catastrophic
Illness Fund (activity 455) shall be transferred to the James
"Tiger" Morton Catastrophic Illness Fund (fund 5454) as provided by
article five-q, chapter sixteen of the code.
The above appropriation for Domestic Violence Legal Services
Fund (activity 384) shall be transferred to the Domestic Violence
Legal Services Fund (fund 5455).
Notwithstanding the provisions of Title I, section three of
this bill, the secretary of the department of health and human
resources shall have the authority to transfer funds within the
above account: Provided, That no more than five percent of the
funds appropriated to one line item may be transferred to other
line items: Provided, however, That no funds from other line items
shall be transferred to the personal services line item.
The secretary shall have authority to expend funds for the
educational costs of those children residing in out-of-state
placements, excluding the costs of special education programs.
The purpose of this bill is to supplement this account in the
budget act for the fiscal year ending the thirtieth day of June,
two thousand three, by amending language with no additional funds
being appropriated.
